They apply to the websites, apps, artificial intelligence solutions and software that Pixel Factory develops for you. The specifics of your project are set out in your proposal.
1. Scope
The proposal describes what we deliver, the plan or the price and the delivery time. What is not in the proposal is not included.
2. Price and payments
You pay 50 % at the start and 50 % on delivery, at the published prices or those in your proposal, with VAT (IVA) included. You can pay by card (also in installments from your bank), in cash or by transfer, and we issue an electronic invoice for each payment.
3. Delivery time
It is the one stated in your proposal. The delivery time is extended to the same extent that the content, access or approvals that depend on you are delayed; we will let you know when that happens.
4. Changes
During development, adjustments within the agreed scope are included. If you ask for something outside the scope, we send you a change order with its cost and its timeline, and we only carry it out if you approve it in writing.
5. Approval and delivery
We show you progress in stages and you approve each delivery in your account or in writing. What you approve as design cannot be claimed later as a design defect, but it can be claimed as a functional defect.
6. Warranty on the work
The warranty consists of fixing at no cost the functional errors in the development we deliver, when it does not work as we agreed in the proposal. Pixel Factory is responsible for it. You report the error to us via WhatsApp at +502 3007-5046, by email to soporte@pixelfactory.gt or from your account, and we confirm to you when it has been fixed. The period is 30 days from delivery, and the fix is made remotely, on the delivered site or system.
The warranty does not cover changes that you or third parties make to the code or the content, failures of third-party services that we did not contract, or new features outside the scope, as long as the failure is not a defect in our development. After the 30 days, with the Monthly plan active, changes remain included.
This does not limit the rights granted to you by the Consumer and User Protection Act (Ley de Protección al Consumidor y Usuario, Decree 006-2003).
7. Intellectual property
When you pay in full, we assign to you the economic rights over the code, the design and the content created specifically for your project. The components we already had and third-party libraries are not assigned: we give you a perpetual license to use them in your project, and third-party libraries keep their licenses. We may show your project in our portfolio, unless you ask us for confidentiality.
8. Access and accounts
We hand over to you the domain, the code and all the access credentials for your project. We only access your site or your content manager with your permission, which you can revoke whenever you want (see Terms of service, section 9).
9. Maintenance
When the project is delivered, the Monthly or Monthly VIP plan starts, which is governed by the Terms of service and the Subscriptions policy.
10. Cancellation
If you are a consumer, you can withdraw within the 5 business days following the contract, and we refund what you paid if we have not yet started working. If you cancel later, we retain only the value of the work performed and the third-party costs already paid for your project (for example, the domain registration), duly documented, and we refund the balance to you.
11. Governing law
These terms are governed by the laws of Guatemala, and the courts of Guatemala have jurisdiction. If you are a consumer, you keep the rights granted to you by the laws of your country of residence and you can go to DIACO.
In Guatemala, the Spanish version of this document prevails.
