1. Who we are
We are Pixel Factory (“we”). We develop websites, apps, artificial intelligence solutions for businesses and business software, and we operate PixelMaker, a site builder, and Alianzas, a directory of verified businesses. Our identification details are in the Legal notice.
2. Acceptance
By using www.pixelfactory.gt, cuenta.pixelfactory.gt or alianzas.pixelfactory.gt you accept these terms. When you contract a service, you also accept that service’s documents (Terms of service, Development services and Subscriptions). In case of conflict, the service documents prevail.
3. Who can use them
You must be over 18 years of age or have authorization from your mother, father or guardian. If you act on behalf of a company, you represent that you can bind it.
4. Your account
You are responsible for keeping your credentials secure. Let us know immediately at soporte@pixelfactory.gt if you think someone has accessed your account. You can turn on two-step verification.
5. Intellectual property
The design, text, brand and software of our sites belong to Pixel Factory or its licensors. The content you upload or publish remains yours; you give us the license needed to host, display and process it only to provide the service to you (see User content). In development projects, ownership of the work is governed by Development services.
6. What is not allowed
Using our services illegally, to deceive or impersonate others, to send spam or malware, to obtain data in an automated way without permission, or to breach security. The details are in the Acceptable use policy.
7. Availability
We work to keep the services running continuously, but they are offered as available: there may be maintenance or provider outages. This does not exclude our liability for willful misconduct or gross negligence.
8. Liability
To the extent permitted by law, we are not liable for indirect damages or for the content of third-party sites we link to. This limitation does not apply in cases of willful misconduct or gross negligence, or damage to life or health, nor does it limit the non-waivable rights granted to you by the Consumer and User Protection Act (Ley de Protección al Consumidor y Usuario, Decree 006-2003).
9. Third-party links
Some links lead to sites we do not control, such as gana.cloud or our customers’ sites. Their terms are those of each site.
10. Use of content by automated and AI systems
On www.pixelfactory.gt and alianzas.pixelfactory.gt we allow search engines and artificial intelligence systems to crawl, index and cite their public content and to use it to train models. The account, at cuenta.pixelfactory.gt, is private: we do not authorize any automated access.
11. Changes
We will notify you of material changes at least 30 days in advance, by email and in your account. Changes do not affect what you have already paid for and, if you do not agree, you can cancel without penalty.
12. Termination
You can stop using the services and close your account whenever you want. We can suspend or close an account that breaches these terms, with notice and a reason, except in urgent cases for security or legal reasons.
13. Governing law
These terms are governed by the laws of Guatemala, and the courts of Guatemala have jurisdiction. If you are a consumer, you keep the rights granted to you by the laws of your country of residence and you can go to DIACO.
